This document reports the general Terms and Conditions of sale and use of the site www.serafica.it which offers online products supplied by the owner of the site: F.A.T. of Serafica A. & C. s.r.l., Strada Comunale Mompilieri, 95030 (hereinafter only “SERAFICA”), Nicolosi (CT) – VAT number: 02442520876; PEC

The SERAFICA online shop was created for sale both to private consumers, to be understood as natural persons of age, and to professional users, to be understood as legal persons interested in purchasing and concluding the contract of its products such as: tea, infusions and herbal teas , spices, coffee and chocolate, honey and jams, tea objects and selection of gift boxes. The sale will take place in compliance with current legislation on the matter, such as the consumer code, the civil code and the legislation on electronic commerce, with particular regard to the regulations on distance contracts.

The sale of the products described above is governed by these General Conditions which specify in detail and in specific sections, the payment methods, delivery times, the right of withdrawal, guarantees and consequent responsibilities. This regulation must be considered an integral and substantial part of the sales contract.

We therefore invite you, before sending your order, to carefully read the conditions of sale as indicated below and the information contained therein. The Owner specifies that any changes, additions or new conditions of sale will be promptly reported to the Customer, will be considered effective from the moment of publication on the site and will apply only and exclusively to sales concluded after their publication on the site.

Art. 1 – Conclusion of the contract

To purchase on www.serafica.it, simply select the products you wish to purchase by placing them in the “shopping cart” and selecting the weight for the loose product; then proceed with the order by making the payment using the chosen methods indicated therein; enter your details to allow delivery.

Sending the order by the Customer constitutes acceptance of the conditions of sale in force at that time. The order sent by the Customer to the SERAFICA online shop must be completed in its entirety and must contain the elements necessary for the identification of the Customer and the products ordered as well as the indication of the place of delivery, under penalty of its nullity. The SERAFICA online shop will send the Customer, via email, a confirmation of order receipt, containing a reference to the applicable conditions of sale.

Art. 2 – Availability and delivery times of products

The SERAFICA online shop undertakes to accept orders within the limits of the quantity of goods available. SERAFICA also undertakes to report products that are not available for purchase, using the words “temporarily unavailable”

In the event that, due to a data error, the product is unavailable, after placing the order, customer support reserves the right to contact the customer to propose a replacement item of equivalent quality and price. If this is not possible, or if the customer does not want replacements, he can decide whether to wait for new availability or cancel the order for that item without additional costs. In any case the cost will be charged only for the value of the goods actually available.

Art. 3 – Right of Withdrawal

The Customer has the right to withdraw from the contract, based on Legislative Decree 22 May 1999, n. 185, without any penalty and without specifying the reason, within 10 days of receipt of the goods, in accordance with correctness and good faith, upon communication by email to info@serafica.it.

In the communication, the Customer must indicate the product or products for which he intends to exercise the right of withdrawal.

In accordance with the provisions of the law, SERAFICA will refund the amount paid or replace it with another product in the manner and within the terms that will be previously agreed with the Customer, unless waived by the Customer.

The right of withdrawal applies to all non-perishable products on the site.

The notice of withdrawal must be made in writing and must contain:

The expression of the desire to make use of the right of withdrawal granted by law;
The indication of the product purchased;
Copy of the order in your possession;
In case of partial withdrawal, code of the item(s);
The data relating to the bank details on which to obtain the transfer (IBAN code – Buyer’s current account).
The right of withdrawal applies only to goods intact at the time of return.

Art. 4 – Returns and refunds of purchased products

The return is free. The return request must be sent by writing to: info@serafica.it within the mandatory deadline of 14 days from receipt of the goods.

It is not possible to return:

-products (food) that risk deteriorating rapidly;

– products that have been opened after delivery;

– products made to measure or personalized according to the customer’s specifications.

In the event that an error is found in the quantity (less than what was ordered and paid), we will credit the amount of the difference or generate a discount of the same amount to be used on subsequent orders.

In the event of receiving an item damaged during transport, the Customer cannot bear the consequences, as all goods travel at our risk. We ask you to help us improve the service by accepting parcels by signing “with reserve”.

Art. 5 – Prices and payment methods

The prices indicated on the website www.serafica.it are in euros and include VAT. Transport costs are excluded.

The prices applied are those indicated on the site at the time of the order. The prices of individual products are subject to change and, therefore, the prices indicated from time to time on the site cancel and replace previous ones. The price of the products purchased, together with the cost of home delivery, must be paid by the Customer when ordering online, by credit card. The documentation will be released by SERAFICA upon delivery.

Art. 6 – Guarantees and responsibilities

SERAFICA, within the limits of availability as regulated above, guarantees that products equal to those indicated and described on the site will be delivered. SERAFICA guarantees compliance with all regulations regarding the conservation of products until delivery to the place indicated in the order. The manufacturer’s responsibility applies to all products sold. In the case of packaged products, the manufacturer is also responsible for the truthfulness and completeness of the information on the packaging. The images on the site are provided to the Customer to facilitate recognition of the products; Due to variations in packaging by the manufacturer, the photos may not exactly reflect the appearance of the delivered product.

Art. 7 – Disputes and applicable law

Civil disputes relating to the application, execution and interpretation of the distance selling contract are subject to Italian jurisdiction and the Court of Catania will be competent. The contracts stipulated remotely with SERAFICA are governed by Italian law and, although not expressly provided for, the relevant legal provisions apply.
